ITOS Standard Limited Warranty for Global Partners

ITOS CO., LTD warrants that if the product proves to have manufacturing defects and ITOS is notified of such within 1 year following substantial completion of the work, ITOS will replace the defective product EXW factory. Such product replacement shall constitute the sole and exclusive remedy for any claim under this warranty.

ITOS does not authorize anyone, including ITOS representatives, to make any statements which may supersede, modify or supplement the information provided on its printed literature or package labels without written confirmation from ITOS headquarters. Any installations proceeding without this confirmation, or mis-installations of the product, will void the warranty.

This warranty also does not cover: improper or defective installation of sealer or coating products not supplied by ITOS; improper maintenance of the finished installation resulting in aesthetic and/or performance problems; substrate failure resulting in delamination of the ITOS product(s) and/or failure of the finished installation; or cracks that develop after application of the ITOS product(s) as a result of the substrate and/or substrate movement.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED, IMPLIED, OR STATUTORY, AND IS STRICTLY LIMITED TO ITS TERMS. ITOS MAKES NO WARRANTY OF MERCHANTABILITY OR SUITABILITY OF ITS PRODUCTS FOR ANY PARTICULAR PURPOSE.

All product demonstrations are placed for illustrative purposes only and do not constitute a warranty of any kind.

ITOS SELLS ITS PRODUCTS UPON THE CONDITION THAT CUSTOMERS SHALL CONDUCT THEIR OWN TESTS TO DETERMINE THE SUITABILITY OF THE PRODUCTS FOR THE BUYERS' INTENDED PURPOSES. UNDER NO CIRCUMSTANCES WILL ITOS BE LIABLE FOR ECONOMIC, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOSSES OF ANY KIND WHATEVER ARISING OUT OF OR OCCASIONED BY THE SELECTION, USE, STORAGE CONDITIONS, INSTALLATION, OR REPLACEMENT OF THIS PRODUCT.

This warranty specifically excludes any installation-related claims.
